SUMMARY OF COMMUNITY GOVERNMENT BYLAW AUTHORITY

The following charts provide a quick reference for community government leaders and staff members on community government bylaws, as legislated by the Charter Communities Act, the Cities, Towns and Villages Act, the Hamlets Act and the Tåîchô Community Government Act.  The information has been divided into the following sections:

  1. Mandatory – bylaws that community governments are legislated to pass;
  2. Recommended – bylaws that community governments must pass in certain circumstances;
  3. Discretionary – bylaws that a community government can choose to pass or not;
  4. General Bylaw Powers and Procedures - the general legislative powers of community governments, including information on enforcement, and the procedures that community governments must follow when preparing and approving a bylaw; and
  5. Other Acts Providing Bylaw Authority – the bylaws community governments can pass under other NWT legislation.

All of the information has been taken directly from the legislation except where indicated by ‘[  ]’.  In order to simplify the document, all references to ‘charter community’, ‘hamlet’ and ‘municipal corporation’ have been replaced by the more generic term community government
